Bankruptcy & Insolvency

Overview

The Bankruptcy & Insolvency legal framework in India is governed by the Insolvency and Bankruptcy Code, 2016 (IBC), which provides a structured process for corporate insolvency resolution, liquidation, and debt recovery.

With rising financial stress in businesses, timely intervention through debt restructuring, voluntary insolvency proceedings, and creditor settlements is crucial for preserving assets and ensuring legal compliance.

Frequently Asked Questions on Bankruptcy & Insolvency

CIRP is a structured legal process under IBC, 2016, allowing corporate debtors to either resolve financial distress through restructuring or move toward liquidation.
Insolvency can be initiated by financial creditors, operational creditors, or corporate debtors when the default amount exceeds ₹1 crore.
CIRP must be completed within 180 days (extendable by 90 days), ensuring a fast-track resolution of insolvency cases.
In liquidation, the company's assets are sold, and proceeds are distributed among creditors as per the IBC waterfall mechanism.
